STANDING ORDER
To effectuate the purposes of the Criminal Justice Act (“CJA”), 18 U.S.C. § 3006A,
and in accordance with the Guide to Judiciary Policy, Vol. 7A, Ch. 2, § 230.26, as well as
the authority vested in the United States Magistrate Judge pursuant to Rule 1 of the Local
Rules for the Assignment of Duties to United States Magistrates, Appendix C of the Local
Court Rules of the United States District Court for the Western District of Texas, it is
hereby ORDERED as follows:
(1) Any criminal case filed on or after the date of this Order shall be
REFERRED to a Magistrate Judge for preparation of a proposed case
budget under the CJA if:
a. the initial or any superseding indictment charges 10 or more
defendants; and
b. any defendant is represented by a private attorney appointed under
the CJA.
(2) The Magistrate Judge is authorized to conduct any proceedings, including ex parte
hearings, necessary for preparation of the proposed CJA budget, and to present
findings of fact and conclusions of law regarding the proposed CJA budget in a
Report and Recommendation to the District Judge presiding over the case.
(3) The proposed budget shall include all attorney, expert, and other
services sought under the CJA.
(4) On motion of either party or on the Court’s own motion, the Magistrate Judge is
authorized to supplement or amend the recommended budget based on changed
circumstances in the case (e.g., the addition of new defendants or charges, or the
withdrawal of retained counsel and subsequent appointment of counsel under the
CJA).
