RE: APPOINTMENT OF UNITED STATES ATTORNEY
FOR THE SOUTHERN DISTRICT OF OHIO
ORDER NO. 25-06
Pursuant to the provisions of 28 U.S.C.§ 546, the Attorney General of the United
States appointed Dominick S. Gerace II as interim United States Attorney. Under 28 U.S.C.
§ 546(c), a person so appointed may serve until the earlier of ( 1) the qualification of a
permanent United States Attorney for such district appointed by the President or (2) the
expiration of 120 days after the appointment by the Attorney General under§ 546(a). Under
28 U.S.C.§ 546(d), if an appointment expires under§ 546(c)(2), the District Court for such
district may appoint a United States Attorney to serve until the vacancy is filled.
The Court is advised that Mr. Gerace's 120-day appointment will expire on
December 8, 2025. The Court is further advised that the nomination and confirmation
process will not be completed by December 8, 2025, and that it is necessary, therefore, for
the Court to appoint a United States Attorney, effective December 9, 2025.
The Court, therefore, pursuant to 28 U.S.C.§ 546(d), does hereby appoint Dominick
S. Gerace II to serve as United States Attorney for the Southern District of Ohio, effective
December 9, 2025, and to serve in that capacity until the vacancy is filled by the person
nominated by the President and the confirmation of that nomination by the United States
Senate, or by further Order of the Court.
