The United States of America, by and through its counsel, Rebecca C. Lutzko, United
States Attorney, and David M. Toepfer, Assistant United States Attorney, moves this Court for
an order, pursuant to Local Criminal Rule 58.2, to amend the schedule of collateral that may be
posted in lieu of appearance in the following manner:
The Department of the Army, Corps of Engineers (COE), through its Office of Counsel,
enforces regulations promulgated by the Administrator of General Services pursuant to Title 36,
Code of Federal Regulations, Section 327. As part of their enforcement efforts, the COE
promulgates a schedule of collateral forfeitures for violations of Title 36, Code of Federal
Regulations, Section 327. A revised version of that schedule was approved by the Corps of
Engineers on April 10, 2024, and necessitates revision of the existing collateral forfeiture
schedule. Additionally, inflation has greatly diminished the deterrent effect of the current fine
list.
It is respectfully requested that pursuant to Local Criminal Rule 58.2 the Schedule for
Forfeiture of Collateral (General Order 2000-34) be repealed and the schedule set forth in
Attachment A be adopted to set the schedule of collateral forfeitures for violations of Title 36,
Code of Federal Regulations, Section 327, throughout the Northern District of Ohio.
Respectfully submitted,
