Wrongful Death Actions, and Actions for Conscious Pain and Suffering of the Decedent
PRE-2024 COMMITTEE NOTE
The Committee believes that paragraph (b) of this Local Civil Rule should logically
apply to actions for conscious pain and suffering of the decedent as well as to wrongful
death actions and therefore recommends that the present distinction between the
Southern and Eastern District versions of the Local Rule in this regard be eliminated.
