PRE-2024 COMMITTEE NOTE
The Committee understands that the power to impose the cost of one day’s attendance
of jurors upon parties who have failed to reach (or notify the Court of) a settlement at
least one business day before trial is exercised only infrequently and in egregious cases.
The Committee agrees that the Court should have this power in order to deal with such
egregious cases, and that the rule serves a useful purpose in notifying the bar that the
Court has this power.
