D. Nev. Standing Order — 2020-10 — IN RE: DELEGATION OF JURY-

1 UNITED STATES DISTRICT COURT 2 DISTRICT OF NEVADA 3 IN RE: DELEGATION OF JURY- 4 SERVICE REPORTING-DATE POSTPONEMENT DECISION TO SECOND AMENDED TEMPORARY 5 GENERAL ORDER 2020-10 CLERK’S OFFICE 6 7 This order amends and replaces Amended General Order 2020-10, dated 8 September 10, 2020. 9 Whereas the Jury Act, 28 U.S.C. §§ 1865(a) and 1866(c), allows the Clerk of Court, 10 under supervision of the Court, to postpone the reporting date for any person summoned 11 for jury service upon a showing of undue hardship or extreme inconvenience if the Court’s 12 jury selection plan so authorizes; and 13 Whereas Section 3.04(c)(2) of the Plan for the Random Selection of Grand and Petit 14 Jurors for the District Court of Nevada, as Amended on January 25, 2017, (“the Jury 15 Plan”) authorizes the Clerk of Court, or any other person authorized by the Chief Judge 16 to assist the Clerk in the performance of duties under the Jury Plan, to temporarily 17 excuse—i.e., postpone the reporting date for—any qualified juror showing undue 18 hardship or extreme inconvenience; and 19 To further clarify what constitutes undue hardship or extreme convenience under 20 § 3.04(c)(2) of the Jury Plan, it is therefore ordered that, until further notice, the Court 21 delegates to the Clerk of Court, as defined in Section 1.03 of the Jury Plan, and 22 specifically to the Court’s jury-services personnel, the authority to grant a temporary 23 excuse to (i.e., postpone the jury-service reporting date to another reasonable date within 24 the wheel for) any qualified juror based on any one or more of the reasons below, each 25 of which the Court deems to be an undue hardship or extreme inconvenience: 26 1. Known or suspected exposure within 14 days before reporting date to 2 someone who has tested positive for COVID-19; 3 3. Inability to obtain substitute care for child or adult relative requiring care on 4 the reporting date; 5 4. Is undergoing or recovering from medical treatment; 8 6. Is a student or teacher who would miss class or other school-related 9 obligations if reporting to appear at the scheduled time, and postponement of 10 service to a scheduled break will eliminate that conflict; 11 7. Is scheduled for temporary work out of state; 12 8. Lives in Nevada only part-time and will not be living at Nevada residence on 13 the reporting date; 14 9. Owns a business, will suffer a specific hardship if required to appear on the 15 reporting date, and can provide a substitute date in the near future that will 16 be less problematic; 17 10. Is employed in a seasonal job, will have to miss that temporary work, and 18 postponement of service to a different season will eliminate that conflict; 19 11. Recently started a new job and is in the probationary period; 20 12. Is unable to drive at night, and postponement of service to the summer 21 months will permit juror to avoid night driving; or 22 13. On the reporting date, the summoned juror is experiencing one of the 23 following situations, and that situation is temporary because it is expected to 24 last 30 days or less: 25 /// 26 /// 27 /// 28 -3- 1 a.
