D. Nev. Standing Order — 2025-07 — 3 IN RE: STAY OF CIVIL PROCEEDINGS

x OCTOBER 2, 2025 1 UNITED STATES DISTRICT COURT 2 DISTRICT OF NEVADA 3 IN RE: STAY OF CIVIL PROCEEDINGS GENERAL ORDER 2025—07 INVOLVING THE UNITED STATES 4 DURING LAPSE OF APPROPRIATIONS 5 Funding for various Executive Branch agencies, including the Department of Justice, 6 lapsed at the end of the day on September 30, 2025. Employees of the affected agencies, 7 including the Department of Justice, are generally prohibited, with limited exceptions, from 8 working during the pendency of the lapse in appropriations, even on a voluntary basis. 9 This court has civil matters involving the United States, its agencies, and its officers and 10 employees, in which the U.S. Attorney’s Office and other Department of lawyers represent 11 litigants. The court needs to minimize expenditures of scarce judicial resources by avoiding 12 large numbers of case-specific motions to stay or extend pending deadlines due to the lapse in 13 appropriations. This constitutes good cause under Federal Rule of Civil Procedure 6 for 14 extending deadlines and staying matters in which the United States, its agencies, and its officers 15 and employees are involved. 16 I THEREFORE ORDER that, effective October 1, 2025, and until further order: 17 1. In all civil actions and civil miscellaneous matters pending in the U.S. District Court 18 for the District of Nevada, all filing and discovery deadlines imposed upon the United States, any 19 of its federal agencies, and any of its officers or employees, are extended by the number of days 20 equal to the length (in days) of the lapse of appropriations plus ten days, provided that if the 21 lapse is seven days or fewer, such extension shall be the number of days equal to the length (in 22 days) of the lapse of appropriations plus five days. 23 1 2. This order does not apply to immigration matters in which a person is detained. The 2 United States may move for a stay in those particular cases, and the presiding judge will resolve 3 such motions. 4 3. Any party seeking relief from this order in any particular civil action or civil 5 miscellaneous matter, must, in addition to serving all attorneys of record, serve the Civil 6 Division of the U.S. Attorney's Office for the District of Nevada by electronic mail at 7 [email protected] with the papers seeking such relief. 8 4. This order does not extend the United States’ deadlines to respond to motions seeking 9 a temporary restraining order, preliminary injunction, or emergency relief. All such motions 10 pending as of October 1, 2025 are exempt from this stay and will be addressed by the presiding 11 judge. Any motion filed after October 1, 2025 seeking such relief against the United States must 12 be served promptly on the Civil Division of the U.S. Attorney's Office for the District of Nevada 13 by electronic mail at [email protected] and on the Civil Chief for the U.S. 14 Attorney's Office for the District of Nevada at [email protected]. The presiding 15 judge will determine whether to lift the stay in that situation. 16 5. The presiding judge in any case may exempt that case from this general stay order 17 based on good cause. 18 6. The U.S. Attorney’s Office for the District of Nevada must inform me when 19 appropriations are restored to the Department of Justice. 20 DATED this 2nd day of October, 2025. 21 22 ANDREW P. GORDON CHIEF UNITED STATES DISTRICT JUDGE 23 2
