IN THE MATTER OF:
SUSPENDING GRAND JURY PROCEEDINGS 21-MC-00004-09
ADMINISTRATIVE ORDER
This Order supersedes Administrative Order 21-MC-00004-05.
WHEREAS, the Court recognizes that the steadily rising number of COVID-19 cases in
the State of New Mexico and surrounding areas has the potential to adversely affect those who
enter any of the federal courthouses within the District of New Mexico.
WHEREAS, the recent State of New Mexico Public Health Emergency Order dated
December 30, 2020, authorized and approved by the Governor of New Mexico implementing
travel and dining restrictions, creates logistical challenges for grand jurors who live more than
100 miles from Albuquerque or Las Cruces from being able to report for jury duty.
WHEREAS, this Court has suspended all civil and criminal jury trials in the District of
New Mexico through February 28, 2021.
IT IS HEREBY ORDERED that effective immediately all grand jury proceedings in
the District of New Mexico are SUSPENDED through February 28, 2021. Due to the
unavailability of a grand jury in this District during the pendency of this Order, the 30-day time
period for filing an indictment is tolled as to each defendant until this Order terminates. See 18
U.S.C. §3161(b).
