Demand For Jury

N.D. Miss. Rule 38

(a) When Due; How Presented. In order to exercise the right to jury trial, a party must make a demand for jury trial, including a removed or transferred action, as may be required by FED. R. CIV. P. 38(b) and 81(c)(3)(A). A designation of jury trial on the civil cover sheet is not sufficient for purposes of this rule. (b) Within Discretion of Court. A request for a jury otherwise presented will be addressed to the sound judicial discretion of the court. (c) Removed Actions; Law and Equity Actions. A civil action removed to federal district court from a chancery court of the State of Mississippi will be designated for non-jury trial.
