Multiple petitioners in this district have filed 28 U.S.C. S 2255 and 28 U.S.C. S 2241
motions challenging their career offender or U.S.S.G. S 2K2.1 sentences under Johnson v.
United States, 135 S. Ct. 2551 (2015). Specifically, in these cases, petitioners are arguing that
under Johnson, one or more of the prior convictions that originally qualified them for
enhancements under U.S.S.G. SS 2K2.1 and 4B1.1 are no longer predicate crimes of violence,
and thus, they are now serving unlawful sentences.
Additionally, many petitioners have filed 28 U.S.C. S 2255 and 28 U.S.C. S 2241
motions challenging their convictions under 18 U.S.C. S 924(c) based on Johnson.
This Court now Orders that the briefing schedule in all pending cases involving Johnson
challenges to career offender or U.S.S.G. S 2K2.1 sentences on collateral review is suspended.
The career offender and U.S.S.G. S 2K2.1 cases will be held in abeyance pending the United
States Supreme Court decision in Beckles v. United States, S. Ct. No. 15-8544. In that case, at
issue is whether Johnson's holding applies to the residual clause of the career offender guideline,
U.S.S.G. S 4B1.2(a)(2), and, if so, whether Johnson's invalidation of the residual clause of the
career offender guideline applies retroactively on collateral review. Beckles will conclusively

resolve the pending guidelines cases if the Supreme Court determines that Johnson does not
apply to career offender cases on collateral review.
Additionally, this Court also Orders that the briefing schedule in all pending cases
involving Johnson challenges to 18 U.S.C. S 924(c) convictions is suspended. The S 924(c)
cases will be held in abeyance pending the United States Court of Appeals for the Fourth
Circuit's decisions in United States v. Hassan Ali, No. 15-4433, United States v. Simms (15-
4640) and United States v. Walker (15-4301). In Hassan Ali, at issue is whether the residual
clause found at 18 U.S.C. S 924(c)(3)(B) is unconstitutionally vague under Johnson and whether
Hobbs Act conspiracy and Hobbs Act robbery qualify as crimes of violence unders924( c).
Simms and Walker each address the force clause of S 924(c) in relation to Hobbs Act Robbery
(Simms) and kidnapping (Walker). Additionally, the Supreme Court is likely to grant certiorari
in Dimaya v. Lynch, 803 F.3d 1110 (9th Cir. 2015), which also addresses the 18 U.S.C. S 924(c)
residual clause. Hassan Ali, Simms, Walker and Dimaya should conclusively resolve the pending
S 924(c) cases if the Fourth Circuit and the Supreme Court find that Johnson does not apply to
the S 924( c) residual clause.
In addition, matters pertaining to 18 U.S.C. S 3559 and U.S.S.G. S 7B1.1 shall be stayed
pending resolution of the matters above as both involve identical definitions of the residual
clauses found at U.S.S.G. S 4B1.2(a)(2) and 18 U.S.C. S 924(c).
Finally, matters pertaining to sentences under 18 U.S.C. S 924(e), the Armed Career
Criminal Act, wherein Maryland's robbery with a deadly weapon statute is a predicate offense
shall be stayed pending the Fourth Circuit's decision in United States v. Riley (15-4317).
Therefore, this Court issues this Order for purposes of judicial efficiency. Within 30 days
after the Supreme Court decides Beckles, the parties must give the Chief Judge a status update on

the pending SS 2255/2241 cases involving Johnson challenges to career offender or U.S.S.G. S
2K2.1 sentences.
Likewise, within 30 days after the Fourth Circuit decides Hassan Ali, Simms, and Walker,
and within 30 days after the Supreme Court decides Dimaya, the parties must give the Chief
Judge a status update on the pending SS 2255/2241 cases involving Johnson challenges to S
924( c) offenses.
Finally, within 30 days after the Fourth Circuit decides Riley, the parties must give the
Chief Judge a status update on the pending SS 2255/2241 cases involving Johnson challenges to
S 924(e) offenses wherein Maryland's robbery with a deadly weapon statute is a predicate
offense.
The cases stayed pursuant to this Order include those on the attached List of Stayed
Cases as of July 25,2016.
