STANDING PROCEDURAL ORDER
AUTHORIZING ENGAGEMENT OF
RESTORATIVE JUSTICE PROGRAM FACILITATORS
BY CRIMINAL JUSTICE ACT ATTORNEYS
This Standing Procedural Order governs cases where counsel is appointed under the
Criminal Justice Act, 18 U.S.C. § 3006A ("CJA"). 18 U.S.C. § 3006A(e)(2)(A) authorizes CJA
counsel to obtain investigative, expert, and other services, without prior authorization but subject
to subsequent review, provided the cost of the services obtained does not exceed $800.00.
In all cases in which the defendant is represented by counsel appointed under the CJA
and elects to participate in the District of Massachusetts Restorative Justice Program, CJA
counsel is hereby authorized to obtain, without prior authorization but subject to subsequent
review, services of one of the Court’s approved Restorative Justice facilitators, the cost of which
exceeds $800.00, provided that the cost does not exceed $2400.00.
