OFFENSES
(A) Uniform Practice. The rules governing the procedure and practice for the
conduct of proceedings in misdemeanor cases, including petty offenses, before United
States magistrate judges under 18 U.S.C. ' 3401, and for appeals in such cases to
judges of the district court, are set forth in the Federal Rules of Procedure for the Trial
of Misdemeanors before United States Magistrate Judges.
(B) Applicability of the Federal Rules of Criminal Procedure.
(1) Generally. Except as specifically provided by the Federal Rules of
Procedure for the Trial of Misdemeanors, the Federal Rules of Criminal Procedure
govern all proceedings, except those proceedings concerning petty offenses for
which no sentence of imprisonment will be imposed.
(2) Petty Offenses Without Imprisonment. To the extent the Federal
Rules of Criminal Procedure are not inconsistent with the Rules of Procedure for
the Trial of Misdemeanors, the magistrate judges may follow provisions of the
Federal Rules of Criminal Procedure as they deem appropriate in conducting
proceedings concerning petty offenses for which no sentence of imprisonment will
be imposed.
