The presumptive rate for compensation of counsel appointed pursuant to 18 U.S.C.

§ 3599(a)(2) in capital habeas corpus cases shall be:

16 • Lead Counsel $226
17 • Co-Counsel $206
18 • Associate Counsel1 $136 - $171
19 These hourly compensation rates apply to work performed on or after January 1,
20 2026. Where the appointment of counsel occurred before this effective date, the new
21 compensation rates apply to that portion of services provided on or after January 1, 2026.

The hourly rate for associate counsel will be based on years of experience as a licensed
attorney.
