A Latin term drawn from Roman law designating a fermented liquor or beverage made from wheat or barley. The Digest passage at 33, 6, 9, pr. sits within the title De Penu Legata (On the Legacy of Provisions), a context entirely foreign to modern common law practice. No meaningful body of English or American case law turns on this term. Researchers in Anglo-American archives will not encounter zythum in reported decisions or statutes. Its presence in Black's Law Dictionary reflects the 19th-century practice of including civil law terminology wholesale, partly to serve practitioners in Louisiana and other mixed-jurisdiction states, and partly as a scholarly completeness convention.

For corpus researchers: the term is a reliable marker for civil law influence in a source. If zythum appears in a document outside a dictionary or glossary, the document is almost certainly engaging directly with Roman or civil law sources rather than common law materials.

Historical Dictionary Support

All three source dictionaries — Black's (1st and 2nd editions) and Burrill's — offer nearly identical one-sentence definitions and cite the same single Digest passage. There is no divergence, development, or interpretive disagreement across these sources because there is nothing to interpret: each is simply transcribing the Digest reference. Black's 2nd edition reproduces the entry with a minor typographical variation ("TIat." for "Lat."), confirming that the entry was carried forward editorially rather than revisited.

The Latin dictionary tradition adds texture the legal dictionaries omit: Pliny (Nat. Hist. 22, 25, 82) and Columella (De Re Rustica 10, 116) both reference zythum as an Egyptian product, giving the term a geographic specificity that the Digest's legal usage does not require. The legal dictionaries, appropriately for their purpose, strip this ethnographic context and retain only the functional classification — a grain-based beverage — relevant to the bequest question the Digest passage addresses.

No historical legal dictionary consulted offers a definition that would be useful to a modern practitioner. The entries exist as civil law glossary relics.

Jurisdictional Note

Relevant, if at all, only within civil law jurisdictions or in academic work on Roman law and its reception. Louisiana courts applying civilian heritage sources might theoretically encounter the Digest classification in historical bequest disputes, but no modern jurisdictional application is established.
